Article 1 Definitions

1.1 General terms and conditions

The general terms and conditions of Yogatherapie Dordrecht, part of Mayleah, which are published on the website of Yogatherapie Dordrecht at https://yogatherapiedordrecht.nl/

1.2 Participant/Student/Pupil/Client

Anyone who is taking or wants to take a yoga class, private class, corporate class, retreat, workshop, session or course.

1.3 Lesson/Session/Workshop/Retreat

That which is organized by Mayleah and followed by the participant.

1.4 Website

1.5 Yoga therapy Dordrecht

Where these regulations refer to Yoga Therapy Dordrecht, this specifically refers to Yoga Therapy Dordrecht, part of Mayleah, registered with the Chamber of Commerce under number 60951338.

Article 2 Applicability

2.1 The general terms and conditions apply to all private lessons, corporate yoga, subscriptions, strip cards, workshops, retreats, courses and sessions at Yogatherapie Dordrecht, part of Mayleah. By participating, the participant agrees to the applicability of these General Terms and Conditions.

2.2 These general terms and conditions apply to all agreements in which Yogatherapie Dordrecht, part of Mayleah, acts as client and contractor.

2.3 During the term of the agreement, the conditions can be changed by Yogatherapie Dordrecht, part of Mayleah. The latest version is always the valid version and available to everyone on the website.

2.4.These terms and conditions do not apply to classes given at yoga studios and gyms.

The conditions of the yoga studio or gym apply.

Article 3 Own risk and liability

3.1 Participation in the lessons is entirely at your own risk.

3.2 Injuries, mental complaints and pregnancy must be reported before the lesson.

3.3 Yogatherapie Dordrecht, part of Mayleah, accepts no liability for material or immaterial damage as a result of any accident or injury to the participant.

3.4 Yogatherapie Dordrecht, part of Mayleah, is not liable for loss, embezzlement, theft or damage, either directly or indirectly, of or to the property of the participant.

3.5 Damage caused by the participant, whether intentionally or unintentionally or through improper use, to property of Yogatherapie Dordrecht, part of Mayleah, must be compensated.

3.6 Yogatherapie Dordrecht, part of Mayleah has the right to cancel a lesson or change location without giving a reason. The lesson will be rescheduled at another time or a refund will be made. This does not apply to lessons given in yoga studios and gyms. The terms and conditions of the yoga studio and gym apply.

Article 4 Corporate Yoga

4.1 The manner in which corporate yoga is implemented is determined by coordination between the company and Yogatherapie Dordrecht, part of Mayleah.

4.2. If the company cancels the yoga class within 48 hours, the agreed amount will be charged.

4.3. The invoice must be paid prior to the service, unless otherwise agreed.

Article 5 Workshop

5.1 Yogatherapie Dordrecht, part of Mayleah reserves the right to cancel a workshop. In that case, the registration fee already paid will be refunded.

5.2 Participant can participate in a workshop after Yogatherapie Dordrecht, part of Mayleah has received the full amount for participation in the workshop. Only after a deposit of 40% of the total amount has been received by Yogatherapie Dordrecht, part of Mayleah, the reservation is final.

5.3 The participant can cancel his registration up to seven days before the workshop, in which case the registration fee/deposit will be refunded minus €7.50 administration costs.

5.4 If the participant cancels within seven days of a workshop, no refund will be made.

Article 6 Retreat

6.1 Participant can participate in a retreat after Yogatherapie Dordrecht, part of Mayleah has received the full amount for participation in the retreat. Only after a deposit of 40% of the total amount has been received by Mayleah, the place is definitively reserved.

6.2 When participating in a retreat, the deposit must be paid no later than 14 days after booking. The remaining amount must be paid no later than 4 weeks before the planned retreat.

6.3 Yogatherapie Dordrecht, part of Mayleah reserves the right to cancel the retreat. In that case, the amount already (partially) paid by the participants will be refunded.

6.4 If an agreement is cancelled after 48 hours of booking, the traveller is liable for the booking costs. The other cancellation costs depend on the time of cancellation:

Up to 8 weeks before departure 15% of the travel sum

From 8 weeks to 6 weeks before departure 30% of the travel sum;

From 6 weeks to 4 weeks before departure 50% of the travel sum;

From 4 weeks to 2 weeks before departure 75% of the travel sum; From 2 weeks to the day of departure 100% of the travel sum.

6.5 If the participant is unable to attend the retreat on site for any reason, any costs already paid will not be refunded.

Article 7 Online Course

7.1 The participant will receive access to the online course after registration and payment of the course.

7.2 The participant must fill in the information truthfully.

7.3The course can be used for a minimum of 6 months.

7.4 Yogatherapie Dordrecht, part of Mayleah is in no way liable or liable for any damage resulting from, or the result of, the (temporary) unavailability or (interim) failure of the course. The participant is responsible for the purchase and proper functioning of the internet connection.

7.5 Yogatherapie Dordrecht, part of Mayleah, has the right to remove (parts of) the course if it deems this necessary.

7.6 The participant may not download, copy, transfer, reproduce, edit or distribute the course material in any way or form.

Article 8 Subscription, strip card, single lesson, private lesson, session and prices

8.1 Yogatherapie Dordrecht, part of Mayleah reserves the right to cancel a lesson. In this case, the lesson will be made up in consultation or the amount already paid will be refunded.

8.2 A subscription or strip card is strictly personal and non-transferable.

8.3 The participant is responsible for attending the lessons. Missed lessons are not eligible for a refund of the tuition fee, unless otherwise agreed.

8.4 The notice period for all subscriptions is one month. The notice must be given by email to Yogatherapie Dordrecht, part of Mayleah via info@yogatherapiedordrecht.nl.

8.5 A strip card is valid for 6 months, unless otherwise agreed.

8.6 The amount for a single lesson must be paid in advance in cash, via online payment request, ideal, or bank transfer, unless otherwise agreed. On request, it is also possible to pay by debit card (before or after the lesson).

8.7 A private lesson must be paid in advance in cash, via online payment request, ideal, or bank transfer, unless otherwise agreed. On request, it is also possible to pay by debit card (before or after the session).

8.8. Up to 48 hours before the start of a private lesson or session, it is possible to cancel a private lesson or session free of charge.

This can be done by email or whatsapp. If the participant cancels his reservation within 48 hours before the start, no money will be refunded, unless otherwise agreed.

Article 9 Prices

All current prices are listed on the website. Yogatherapie Dordrecht, part of Mayleah reserves the right to change prices.

Article 10 Personal data

10.1 Yogatherapie Dordrecht, part of Mayleah collects personal data of its participants/clients for the purpose of maintaining its file, for the execution of payment orders and for the administration. Yogatherapie Dordrecht, part of Mayleah handles this collection of personal data with care as laid down in the privacy policy of Yogatherapie Dordrecht, part of Mayleah, which can be found on the website https://yogatherapiedordrecht.nl/privacyverklaring/

Article 11 Medical Disclaimer

11.1 The activities we offer are not intended to replace medically necessary treatment. Always discuss physical and/or psychological complaints with a doctor before booking a lesson or session.

11.2 If you have any physical complaints, these must be reported prior to the lesson/session.

11.3 Participants are expected to take physical complaints seriously and not force anything. Participants are responsible for this themselves.

Article 12 Applicable law and competent court

12.1 Dutch law applies to the legal relationship between Yogatherapie Dordrecht, part of Mayleah, and its participant.

12.2 All disputes that may arise between Yogatherapie Dordrecht, part of Mayleah and the participant, will be submitted to the competent court.

Article 13 Complaints procedure

13.1 If the participant has a complaint, it must be sent with reasons to info@yogatherapiedordrecht. The complaint will be processed within 5 working days of receipt, if reasonably possible.

13.2 Participant has the option to submit a complaint to the Disputes Committee via the European ODR Platform, which can be found at http://ec.europa.eu/consumers/odr/.
